La déréglementation brutale qui sévit depuis quelques années dans une région du monde jusque là fortement réglementée, l’Europe, n’est pas sans créer de nombreux problèmes pour les entreprises et leurs clients. Le double phénomène de la création du marché unique européen puis de la libéralisation accélérée des échanges mondiaux a fortement mis à mal l’édifice complexe des réglementations nationales et communautaires sans que l’on puisse affirmer que les clients ou l’éthique des affaires y aient beaucoup gagné. L’étude fournit de nombreux (...) exemples relatifs aux télécommunications, au gaz naturel, à l’électricité, la poste, les assurances, la grande distribution, la gestion de l’eau et des déchets ou les chemins de fer. A theory can be an explanation of a piece of the world. A theory of law is intended to be an explanation of that phenomenon of social communication which we call Law. But, Raffaele De Giorgi, perhaps the person responsible for the introduction of luhmannian theory in Argentina, (jointly with Torres Nafarrate in Mexico in translating Luhmann’s work to Spanish), asked: What is a theory of society? What is the “Law of society”? And answered: Can we discuss this?, hands managed (...) by hands, nothing different from a prostheses. According to De Giorgi we are sure that the themes that we use as objects or objects that we use as themes, are our construction, we think that we turn around ourselves, while we continue rotating around the vacuum. It is a paradox, or another paradox: ¿Is it possible to get out or get rid of these paradoxes? Logic does not help us. Logic, according to Luhmann, can only see to the fact that some expressions, with unavailable truths, are in contradiction with other expressions, the problem cannot be resolved us- ing logical operations. With the help of Gegenparadoxierungen (against-par- adox), systemic therapy is the alternative where the problem can be toler- ated. And, according to Luhmann, the placement of the paradox should be conducted in a more or less skilled, successful, or useful way to break the logjam.A creative use of paradoxes, especially legal ones, allows us to observe how Luhmann’s theory has impacted existing theories in ArgentinaThemes such as the paradoxality of law, or its being without foundation (and without beginning, the vacuity of their principles and the opacity of its distinctions and operations), filtered theories (like Carlos Cárcova or Ernesto Grün) and jurisprudential practices have started shifting things to what Bielefeld Professor has called “old European”Resumen:Una teoría puede ser una explicación de un sector del mundo. Una teoría del derecho pretende ser una explicación de ese fenómeno de comunicación social que llamamos derecho. Pero, Raffaele De Giorgi, tal vez uno de los máximos responsables de la introducción de la teoría de la luhmanniana en la Argentina (junto a Javier Torres Nafarrate de México, a través de su traducción de las obras de Luhmann al español), pregunta:¿Qué es una teoría de la sociedad? ¿Qué es el “Derecho de la sociedad”? y responde: es que podemos discutir esto?, manos que son manejadas por manos, nada diferente de una prótesis. La lógica no nos ayuda. La lógica dice Luhmann, sólo puede ver el hecho de que algunas expresiones, cuya verdad no está disponible, entran en contradicción con otras expresiones, para las cuales vale decir la misma cosa. Usando operaciones lógicas, el problema no puede ser resuelto. Como terapia sistémica la única que podemos ver, con el auxilio de la Gegenparadoxierungen (“contra-paradoja”), es un lugar menos doloroso en el que puede tolerarse el problema. Y recordó que, en cierto sentido, la colocación de la paradoja se realizará con más o menos éxito, esto es: de manera útil para desbloquear la situación.Y es el uso creativo de paradojas, especialmente uno que se hizo por el Derecho, el que nos permite observar cómo su teoría (la de Luhmann) se ha comenzado a reciclar en las teorías existentes en Argentina. Temas como el problema de la paradojalidad del Derecho, de su ser sin fundamentos y sin comienzo, de la vacuidad de sus principios y la opacidad de sus operaciones y distinciones, se filtran teorías (como las de Carlos Cárcova o Ernesto Grün) y prácticas de la jurisprudencia y puede verse que ha comenzado a remover ese tipo de pensamiento que el profesor de Bielefeld había llamado “vétero europeo”. _Introducción_: la Limitación del Esfuerzo Terapéutico (LET) busca reorientar las medidas del acompañamiento terapéutico durante el final de la vida; actualmente existe legislación sobre este tema. _Objetivo: _caracterizar el conocimiento y la claridad conceptual y jurídica del personal de salud del Hospital de San José (HSJ) de Bogotá sobre la LET. _Métodos: _estudio descriptivo transversal usando encuesta de libre preparación. Se estableció claridad conceptual con resultado superior al 70% de respuestas correctas. Datos levantados con cuestionario de selección múltiple vía Formularios (...) Google, tabulados en Microsoft Excel ® y analizados con Stata ® vía estadística descriptiva. _Resultados:_ 36 % de encuestados tuvo claridad conceptual y jurídica sobre LET; el 82,3 % de encuestados diferenciaron LET de eutanasia y el 95,6 %, LET de cuidados paliativos. El 61 % de los encuestados no tuvo conflicto moral/jurídico con LET; el 60 % y el 70 % de los encuestados creen, respectivamente, que suspender el oxígeno y la ventilación mecánica no hacen parte de la LET. Finalmente, el 78,9 % expresó no haber recibido suficiente información sobre el tema. _Conclusiones_: el personal encuestado carece de claridad conceptual suficiente sobre la LET,lo que señala la necesidad de mayor educación al respecto. Switzerland provides a potential laboratory for testing various hypotheses connected with tax competition because of its extremely decentralized fiscal system. Twenty-six cantons have retained the ultimate power of deciding tax questions, and hence not only to limit the Federal level of the State to about 1/3 of total public expenditure, but also to retain absolute power to set their own levels of taxation. Furthermore, citizens can launch referenda on tax issues at any level of government.Fiscal competition between cantons should therefore (...) be easy to spot, resulting in lower tax cantons enjoying higher economic growth, or in a “race to the bottom” with lower tax cantons offering a lower level of public services. In fact, neither of these hypotheses is confirmed. This leads the author to suggest a third hypothesis based on public choice theory. The author suggests that the classical and the public choice hypotheses cancel each other out, leaving a mixed picture. The article ends with some reflexions on the implications of the Swiss experience for fiscal harmonization at a European level.La Suisse offre un véritable laboratoire pour tester plusieurs hypothèses de concurrence fiscale en raison de son système fiscal extrêmement décentralisé. Vingt six cantons ont conservé le pouvoir suprême de décider les questions fiscales et, donc, non seulement de limiter le niveau fédéral de l’Etat à 1/3 des dépenses publiques totales, mais aussi de conserver le pouvoir absolu pour fixer leurs propres niveaux de taxation. De plus, les habitants peuvent lancer des référendums en matière fiscale à tout niveau du gouvernement.La concurrence fiscale entre les cantons devrait être par conséquent plus facile à repérer, les cantons les moins imposés ayant une croissance économique supérieure, ou en un « nivellement par le bas » face aux cantons les moins imposés offrant un niveau inférieur de services publics. En fait, aucune de ces hypothèses n’est confirmée. Cela conduit l’auteur à suggérer une troisième hypothèse basée sur la théorie des décisions publiques. L’auteur suggère que les hypothèses classiques et celles des décisions publiques se neutralisent l’une l’autre, laissant place à un modèle mixte. L’article se termine par quelques réflexions quant aux implications de l’expérience Suisse pour une harmonisation fiscale au niveau européen. (shrink)

This article points to the highly centralized nature of the British tax system. A first section shows how all tax law derives from Parliament, the “onlie begetter” of legally enforceable instruments. It is suggested that this system is not democratically accountable at sub-national levels of government. Reforms of the Thatcher era have resulted in the privatization of many public services, leading to the stabilization of State expenditure as a proportion of GDP. However, at the same time, both tax revenue and (...) expenditure have become increasingly centralized. Public service tasks are determined and financed by central government, and local government is for the most part merely the agent through which government policy is realized. The creation of the Scottish and Welsh Assemblies does not alter this overall assessment. Given the high level of centralization, taxes are uniform throughout the country and there is no scope for meaningful regional fiscal competition. Since regional economic development in Britain is notoriously uneven, the author notes that fiscal uniformity does not lead to economic convergence. A final section is devoted to showing why this is not surprising and why fiscal harmonisation at a European level would be a source of growing, not reduced, disparities.Cet article met l’accent sur la nature hautement centralisée du système fiscal britannique. Une première section montre comment toutes les lois fiscales proviennent du Parlement, la “source unique” des instruments légaux exécutoires. Nous considérons que ce système n’est pas démocrat- iquement defendable aux niveaux subnationaux de gouvernement. Les réformes de l’ère Thatcher ont conduit à une privatisation de beaucoup de services publics, entrainant une stabilisation des dépenses de l’Etat en pourcentage du PIB. Cependant, dans le meme temps, à la fois les recettes fiscales et les dépenses sont devenues de plus en plus centralisées. Les taches du service public sont définies et financées par le gouvernement central et le gouvernement local est dans la majeure partie des cas l’agent à travers lequel la politique du gouvernement s’exerce. La creation des Assemblées Ecossaises et galloises ne modifie pas cette evaluation d’ensemble. Etant donné le niveau élevé de centralisation, les impôts sont uniformes à travers le pays et il n’y a pas de possibilité pour une concurrence fiscale régionale significative. Alors que le développement économique regional en Grande Bretagne est notoirement inégal, l’auteur remarque que l’uniformité fiscale ne conduit pas à uneconvergence économique. Une section finale est consacrée à montrer pourquoi cela n’est en rien surprenant et pourquoi l’harmonisation fiscale à un niveau européen serait une source de disparités croissantes, et non décroissantes. The aim of the present paper is to attack some of the conceptual problems that arise when the framework of mathematical learning theory is applied to the description of the behavior of the firm, in setting prices and production quotas, in a competitive market. The goal is to depict the process by which the firm fixes prices and production quotas as a stochastic learning process. A solution to such problems is proposed which is based on statistical-decision concepts. The conceptualization of (...) the behavior of the firm by means of concepts pertaining to mathematical learning theory gives rise to certain mathematical problems, which are formulated here in rather precise terms. This book explores the under-researched sources of the consumerist culture and the environmental damage it has brought about. The book is an outcome of the symposium on “The Ethics of Consumption” organised and hosted by the Las Casas Institute at the Blackfriars Hall, University of Oxford as part of its Economics as a Moral Science Programme. It takes on two contemporary problems: the human weakness and capacity for wrong-doing, and the failure of modern economic theory to account for the moral (...) character of human behaviour and its implicit encouragement of gluttonous life-styles. In a time when grand political schemes are proposed to revive sustainability of global economy, the authors of the papers collected in this book highlight the need for moral renewal without which the most revolutionary structural reforms are bound to fail at producing the desired outcome. Topics of the book include the meaning and sources of avarice, the attempt to define what is enough, exploration of philosophical and theological perspectives which can serve as building blocks for the ethics of consumption.
